White vs Hart An interesting U.S. Supreme Court case which had its origins in Chattooga County. The plaintiff in the case had sold a slave to the defendant on credit, prior to the commencement of the Civil War. Now, after the War had ended and the slaves had been freed, the plaintiff filed a lawsuit in Chattooga County in an attempt to to collect the debt. The defendant argued that under the new Georgia Constitution (adopted after the War) the courts could not legally enforce a debt incurred for the purchase of a slave. The Chattooga County Superior Court judge agreed, and dismissed the case; the Georgia Supreme Court affirmed the decision. The determined plaintiff appealed to the U.S. Supreme Court: |
