WIDOW’S AFFIDAVIT

STATE OF GEORGIA

Banks County.

            Personally before me comes Mrs. N. E. Boswell of said County, who, after being duly sworn, says that she is the widow of W. W. Boswell to whom, in the County of Newton State of Georgia she was married in the Fall of 1871, and that she remained his wife, and resided with him to the date of his death in Nov. 29 1917 and that she has not since his death remarried.  At the time of his death he was a resident of Banks County, in said State of Georgia, and he was on the Ind. & Serv. Pension Roll of said State and paid a pension of $80.00 in Banks County for 1918 per annum, on account of being a soldier in Company (blank) Regiment (blank). (Volunteers or State Militia)

            That she is now a bona fide resident citizen of said County of Banks and she has so continuously resided since 1884.

AFFIDAVIT OF WITNESSES TO PROVE MARRIAGE AND TO WHOM.

            Personally before me comes D. I. Hoopaugh known to be responsible and truthful persons, residing in said County, who after being duly sworn, say: that of their own personal knowledge Mrs. N. E. Boswell, who made the foregoing affidavit, is the lawful widow of W. W. Boswell who died in Banks County in said State of Georgia on 29 day of Nov. 1917, and that she has not since remarried.  That she became the wife of W. W. Boswell in the Fall of 1871, and that she and he resided together as man and wife continuously since marriage in 1871, and that the W. W. Boswell was the same man who was on the pension roll of said State Georgia from Banks County(blank) when he died.

            I, W. M. Thomas Ordinary of said County, do hereby certify that I know Mrs. N. E. Boswell the applicant for this pension, and that she is the person she represents herself to be, and that she is a bona fide continuing resident of said County and was on the (blank) day of (blank)19_.

            That I also know D. I. Hoopaugh witness as to marriage and I also know (blank); that both of the foregoing were duly sworn by me before signing the respective affidavits, and that they are truthful and trustworthy and their statements are entitled to full faith and credit.

APPLICATION for PENSION Due DECEASED SOLDIER

To Be Paid to His Widow or Dependent Children

Under Act Approved October 9, 1891.

            Personally before me comes Mrs. N. E. Boswell, of said county and after being duly sworn, on oath says that she is the widow of W. W. Boswell who was duly enrolled as a indigent & Service Pensioner from the county of Banks and was paid a Pension of Seventy Dollars from Banks county for 1917, and that the said W. W. Boswell died in Banks county on the 29 day of Nov. 1917, and at the time of his death a Pension of $80.00 was due him from Banks county and unpaid for 1918.  Applicant further swears that she married the said W. W. Boswell on 30 day of Oct. 1870 in Newron county and State of Georgia, and resided with him from date of marriage to his death as his lawful wife, and is now his dependent widow, and she asks the Pension so due and unpaid be paid to her.

            Personally before me comes Mrs. S. M. Hembree, who on oath says that she knew W. W. Boswell while in life and that she knows his widow, Mrs. N. E. Boswell the above applicant; that she knows that the said W. W. Boswell and N. E. Boswell were in due form married in the county of Newton in the State of Georgia on the 30th day of October, 1870, and that they resided as husband and wife from the date of marriage to the day of his death on the 29th day of Nov. 1917, and I know she is his dependent widow.

Boswell Dec’d., and was on the Ind. & Service Pension Roll of said Banks county, and was paid a Pension from Banks county for 1917, and at the time of his death the 29 day of Nov. 1917, there was due to him and unpaid his Pension of Eighty Dollars from the State of Georgia, and I know Mrs. S. M. Hembree, the within witness, and she is of truthful and trustworthy character end entitled to full credit.

            Before me, the Ordinary of said County, comes C. C. Ward, of said County, who after being duly sworn, on oath says that he knew Mrs. N. E. Boswell, late of said County, a Confederate pensioner, and that said person is the identical person named and described in the attached certified copy of burial certificate; and that the said pensioner left no widow and no estate of any kind or value sufficient to pay the expenses of last illness and funeral, which amounted to the sum of $196.00, as shown by sworn statements fully and completely itemized, hereto attached.

            I certify that C. C. Ward who subscribed to the foregoing affidavit is known to be a person whose statement is entitled to full faith and credit.  I further certify that I knew Mrs. N. E. Boswell the deceased pensioner referred to in the foregoing affidavit and that the deceased was at the time of death regularly enrolled as a pensioner on the records of file in my office.  I further certify that said deceased pensioner is the identical person named and described in the attached certified copy of burial certificate, and was not survived by a widow and left no estate of any kind sufficient to pay the expenses of last illness and burial for which claim is made.
