Petition of Mary F. Maxwell for binding apprenticeship of Samuel
Maxwell, freed boy, 1867.
January 7th 1867, In Chambers.
Georgia,
Banks County.
To the Honorable the County Court of said County.
The petition of Mary F. Maxwell of said County
Respectfully sheweth that Samuel Maxwell a freed man of said County is a minor
and under twenty one years of age. That
your petitioner raised said minor from an infant that said minor has no parents
or property sufficient to support him.
Your petitioner therefore asks your honor to bind to your petitioner the
said minor for the term of five years, from this date, at the expiration of
which time the said Minor will be twenty one years old and your petitioner hereby
agrees to teach said Minor the business of farming and house service and will
fully comply with all the requirements of the statute in such case made and
provided.
This January 7th 1867.

In person appeared before me the undersigned County
Judge in and for said County Mary F. Maxwell who being duly sworn deposes and
says that the facts stated in the foregoing petition are just and true.

It appearing to the Court that Samuel Maxwell (a freed
boy) is a minor sixteen years old and that he has neither parents or guardian
and no estate sufficient for his support.
It is therefore ordered that the said Samuel Maxwell be bound to service
to Mary F. Maxwell until he shall arrive at the age of twenty one years to be
taught the business of farming and house service upon her giving the bond and
complying with the terms of the statute in such cases made and provided.

Know all men by these presence [sic] that we Mary F.
Maxwell as principle and Micajah Estes as Security are held and firmly bound
unto D. G. Candler County Judge in and for said County for the time being and
his Successors in office in the just and full sum of five hundred dollars for
the true payment of which we bind ourselves, our heirs, executors and
administrators jointly and severally and firmly by these presence. Sealed with our Seals and dated this the 7th
day of January 1867.
The condition of the above bind is such that where it
has been shown to the Court that Samuel Maxwell is a minor now sixteen years
old and that he has neither parents or guardian and no estate or visible means
of support, And where the County Court has this day passed an order binding
said freed boy Samuel Maxwell to Mary F. Maxwell untill [sic] he shall arrive
at the age of twenty one years, to learn the business of farming and house
service . Now shall the said Mary F.
Maxwell well and truly fairly treat said apprentice and furnish him with the
necessary Food and Clothing and medical attention during his minority and shall
cause him to be taught to read and write and the primary rules of arithmetic
and at the termination of his apprenticeship shall pay him the sum of one
hundred dollars, or other compensation as is provided by Law, then this bind be
null and void, otherwise to remain in full force and virtue.
