The petition of Samuel Bowers sheweth the his father Stephen Bowers of said state and district died

intestate on the 13th day of November AD 1860. Sworned by the following persons as his only heirs and

distributees to wit six children and two families of grandchildren viz: David Bowers, Jacob Bowers, Nancy

Maffett wife of Robert Maffett. Elizabeth Fellers wife of George Fellers, Sarah Wheeler wife of Jacob

Wheeler and yours petition. George W. Bowers, Levi Bowers, Jacob S. Bowers, Andrew M. Bowers, John

Bowers and Nancy Young wife of Abraham Young. Children of Andrew Bowers died who was a son

intestate and Jacob Bowers, Caroline wife of and Martha Stafford wife of William B. Stafford children of

George Bowers dec'd. Pg. 2. That

said intestate dec'd possessed of a personal estate worth some two thousand dollars or twenty five hundred

dollars as is believed. That no administration of the same has been granted to any one wherefore your

Whereas Samuel Bowers has applied to me for Letter of Administration, on and singular the goods and

chattels, rights and credits of Stephen Bowers late of the District aforesaid, deceased:

These are therefore to cite and admonish all and singular, the kindred and creditors of the said deceased, to

be and appear before me, at our next Ordinary's Court for the said District, to be holden at Newberry Court

House on the twenty second day of February tenth to shew cause, if any, why the said Administration

should not be granted.

Given under my hand and Seal, this Seventh day of February in the year of our Lord one thousand eight

Newberry District

Know all men by these Presents, That we Samuel Bowers are holden and firmly bound unto E. P. Lake

Ordinary for the District of Newberry in the full and just sum of five thousand dollars lawful money of this

State, to be paid E. P. Lake or his successors, Ordinaries of this District, or their certain attorney or assigns.

To which payment well and truly to be made, we bind ourselves, and every of us, our and every of our

Heirs, Executors and Administrators, for the whole, and in the whole, jointly and severally, firmly by these

Presents.

Sealed with our seals, and dated the fourth day of March in the year of our Lord one thousand eight

hundred and sixty one.

NOW THE CONDITION OF THE ABOVE OBLIGATION IS SUCH, that if the above bound Samuel

Bowers Administrator of the goods, chattles and credits of Stephen Bowers deceased, do make a true and

perfect inventory of all and singular the goods, chattles and credits of the said deceased, which have or

shall come to the hands, possession or knowledge of the Samuel Bowers or into the hands or possessin of

any other person or persons for him and the same so made, do exhibit into the said Court of Ordinary, when

he shall be thereunto required, and such goods, chattles and credits do well and truly administer according

to law, and do make a just and true account of him actings and doings therein when required by the said

Court, and all the rest of the said goods, chattels and credits which shall be found remaining upon the

account of the said administration, the same being first allowed by the said Court, shall deliver and pay

unto such persons respectively as are entitled to the same by law; and if it shall hereafter appear that any

last will and testament was made by the said deceased and the same be proved in Court, and the Executors

obtain a certificate of the probate thereof, and the said Samuel Bowers do in such case, if received, render

and deliver up the said Letters of Administration, then the obligation to be void, or else to remain in full

force.

To Samuel Bowers, Whereas, Stephen Bowers late of and at the time of his death, divers goods, rights and

credits within the State aforesaid; by means whereof the full disposition and power of granting the

administration of all and singular goods, rights and credits of the said deceased, and also auditing the

accounts, calculations and reckonings of the said administration, and a final dismission of the same, to me

is manifestly known to belong. I, desiring that the goods, rights and credits of the said deceased, may be

will and truly administered, and converted and disposed of, do hereby grant unto the said Samuel Bowers in

whose fidelity, in this behalf, I very much confide, full power by the tenor of these presents, to administer

the goods, rights and credits of the said deceased, which to him in his life-time, and at the time of his death,

did belong; and to ask leave, recover and receive the same to pay the debts in which the deceased stood

obliged, so far forth as his goods, rights and credits will extend, according to their rate and order of law;

being first sworn in the Holy Evangelist of Almighty God, to make a true and perfect inventory thereof, and

to exhibit the same into the Ordinary's office in Newberry District in order to be recorded, on or before the

first day of May now next ensuing; and to render a just and true account, calculation and reckoning of the

said administration, when thereunto required: And I ordain, depute and constitute you, the said Samuel

Bowers Administrator of all and singular the goods, rights and credits of the said deceased In Testimony

Whereof, I have hereunto set my hand, and Seal, this 4th day of March in the year of our Lord one

Stephen bowers deceased, wheresoever any of the said goods and chattles are or do remain within the said

parts and places, and which shall be shown unto you by the said Samuel Bowers and there view and

appraise all and every the said goods and chattles, being first duly sworn on the Holy Evangelist of

Almighty God, to make a true and perfect inventory and appraisement therof, and to cause the same to be

WILL OF JACOB BOWERS

In the name of God, Amen, I, Jacob Bowers of the County of Fayette and State of Georgia, being of sound

mind and memory do hereby make, publish and declare this my Last Will and Testament hereby revoking

and making void all former wills made by me at any time heretofore made.

1st. I order and direct my executors as soon after my decease as practicable to pay off and discharge all the

debts, dues, and liabilities that may exist against me at the time of my decease.

2nd. I give and bequeath unto my wife, Jemima Bowers, one hundred one and one fourth acres East half of

Lot. (No.) (35) Thirty five in the sixth district of Fayette County, containing (101 1/4 acres more or less and

all the household and kitchen during her lifetime or widowhood, then after my wife's decease, to my lawful

heir.

3rd. (Missing)

Fourth 4. I, hereby nominate and appoint James M. Arnoll, my executor, in witness whereof I have

hereunto subscribed my name this March 25, 1879.

On this the 17th day of April 1863 personally appeared before me, Richard Dorman, a Justice of the Peace

in and for the county and state aforesaid Delilah J. Bowers who being duly sworn according to law deposes

and says that she is the widow of Levi Bates Bowers, deceased, who was a private of Capt. Huies Company

G 44th (Inf. Regt.) Ga Volunteers commanded by Colonel Robert A. Smith in the service of the

Confederate States in the present war with the United States that the said Levi Bates Bowers entered the

service at Griffin in Spaulding County, State of Georgia on or about the 12th day of May 1862 and that he

died at Danville on or about the sixth day of January 1863 and that she makes this deposition for the

purpose of obtaining from the Government of the Confederate States whatsoever may have back due the

said Levi Bates Bowers at the time of his death for pay bounty or other allowances for his service as a

private aforesaid from to and subscribed before me.

I have not been able thus far to substantiate the above marriage record with valid proof.

There was no marriage record to be found Vital Records or the Probate Office in Fayette County, Georgia.

I contacted the Fayette County, Georgia Historical Society and they could not find their marriage among

their records.

I have checked with the marriage listings on the internet but came up with nada.

I even checked with the Georgia Department of Archive & History and they could not find their marriage

records either.

Levi Bates Bowers did indeed marry Delilah Jane Ward for his service records prove that they were

married there. Richard Dorman, a Justice of the Peace in Fayette County, appeared in Superior Court on 17

April 1863, saying on oath that he knew the deceased soldier Levi Bates Bowers and Delilah J. Bowers;

that she was his widow.

Delilah appeared before the court on the above date because she wanted the dues that were owed to her

deceased husband from the government for his service in Company G of the 44th Infantry of the Georgia

Volunteers. *

I found several discrepanies in Levi's service records. There was some confusion about date of enlistment

as well as his date of death. There were at least, two other Levi Bowers besides Levi Bates Bowers and one

of them was also in the Confederate Army and I believe this is where the discrepanies originated in their

records.

unto your Honor as follows:

1. That on the 29th day of January 1916, James N. Griggs who was then and for many years before a

resident of said state and county, departed this life at his residence in this county and State leaving

surviving him his widow, your petitioner, and eight children as follows: Rhodum Griggs, Gadsden, Ala.,

Pearl Ferguson, Winkler, Tex., Nannie Morrow, Union Grove, Ala., Jim Griggs, Union Grove, Ala., Evvie

Griggs, Union Grove, Ala., all of whom were more than twenty one years of age at the time of death of the

said James N. Griggs; also Jesse Griggs, Union Grove, Ala., Dovie Whisenant, Union Grove, Ala., Willie

Griggs, Union Grove, Ala., who were all at the time of the death of James N. Griggs minors.

2. That the said James N. Griggs at the time of his death was seized and possessed of the following

property; to-wit: The East half of the South West fourth, the South half of the North west fourth, Sec. 15,

Township 7, Range 1 East being in Marshall Co., Ala., containing one hundred fifty eight & 75/100 acres,

less forty acres on North West corner of said land. And the following described personal property to-wit:

One mule, one cow, one heifer & five hogs. The said real estate being in area less than one hundred and

sixty acres and being of less valve than two thousand dollars in valve with the improvements thereon. The

said property being of value less than one thousand dollars.

3. That all of said property, both real and personal was at the time of the death of the said James N. Griggs

and is now in Marshall County, Ala.

4. That there has been no administration of the estate of the said James N. Griggs in said County, nor in any

other county and that more than sixty days have elapsed since the death of said James N. Griggs.

Wherefore your petitioner, Sarah Elizabeth Griggs, the widow of said James N. Griggs, makes application

to your Honor for the appointment of commissioners; citizens of Marshall County in and standing, to make

a complete inventory of all the personal property exempt to her as the widow of James N. Griggs now

deceased, under and according to the provisions of the laws of this state, and as in duty bound she will

In the matter of the Estate of James N. Griggs deceased.

To Hon. John H. Carter, Judge of Probate of said County.

We, the undersigned Commissioners, heretofore appointed by an order duly entered in said Court on the 21

day of Oct. 1916 to make and return to this Court a full and complete Inventory and Appraisement of the

real and personal property of the said James N. Griggs at the time of his death with a description and value

of the items thereof, and the amounts of liens or incumbrance thereon at the death of said decedent,

respectfully reports that, after being duly sworn according to the law the following Inventory,

Appraisement value of property and the sum of liens theron at the death of said decedent are as follows:

We also beg to report that we have set off and alloted to Sarah Elizabeth Griggs widow & Jessie Griggs,

Dovie Whisenant & Willie Griggs the following described propety, which was the homestead of said

decedent: The E 1/2 of the S.W. 1/4 and the S.E. 1/4 of the N. W. 1/4 all in Section 15, Township 7, Range

1 East, containing 120 acres, being and lying in Marshall Co., Alabama. Valued at ($1000.00) One

Thousand Dollars, all of which we respectfully submit.

To A. B. Black and W. T. Stone

You are herby commissioned and directed to set a pay to Sarah Elizabeth Griggs, widow, and Jessie

Griggs, Dovie Whisenant & Willie Griggs of said decedent, the personal propety exempt to them by law as

follows to-wit: All the wearing apparel of the decedent and of the family, all cloth and yarn on hand

intented for their use and consumption, all books kept for use in the family and family portraits and

pictures, all grain, stores and groceries on hand necessary for the support of the family for twelve months

after decedents death, all bedding, household and kitchen furniture necessary for the use and comfort of

said widow and minor children to be selected by the said widow and in addition hereto, one thousand

dollars in value of the personal property of said estate, allowing the said widow to select the same.

You will also appraise the homestead of the said decedent occupied by him at the time of his death, or to

which he was then entitled with a full accurate description of the same and if it is a part of a tract of land,

whether or not it exceeds in area one hundred and sixty acres and make due return according to law.

Deed Estate Order Confirming Exemptions

More that 30 days ago, on to-wit: Nov. 17, 1916 came A. B. Black & W. T. Stone, Commissioners

heretofore appointed by this court to appraise and set apart to Sarah Elizabeth Griggs, widow and Jesse

Griggs, Dovie Whisenant and Willie Griggs minor heirs of said deceased, and filed their report in writing

and under oath, and it appearing to this court that said report inventory and appraisement of said

commissioners has been filed in this court more than thirty days as is required by law, and that there has

been no exceptions or objections filed thereto and it being determined, adjudged and decreed by the court

that the property set aside as exempt to the said widow and minor children as a homestead, and as exempt

personal propetty was all the property real and personal owned by said deceased at the time of his death,

and that he left less property both real and personal, there is allowed said widow and minor children both in

area evaluation. It is therefore ordered, adjudged and decreed by the court that said report inventory and

appraisements and said exemptions be and the same are in all things ratified and confirmed.
