I, Levicy Whitaker of said State
and County being of advanced age but of sound and disposing mind and
memory knowing that I must shortly depart this life, deem it right and
proper that I should make a disposition of the property with which a
kind Providence has blessed me ~ I do therefore make this my last will
and testament hereby revoking and annulling all others by me heretofore
made ~
1st I desire and direct that my body be buried in a decent &
christian like manner suitable to my circumstances & condition in
life.
2nd I desire & direct that all my just debts be paid
without delay.
3rd I give and bequeath to my son Simon T. Whitaker
my buggy & Harness, my wagon, and farming tools & my two mules,
Gussie? & Rhoda to him the said Simon forever.
4th I give
and bequeath to my two grand sons Seborn and Martin Sams the sum of
five dollars to each of them.
5th I give and bequeath the residue?
of my property to my two daughters Mary Jane Roberts wife of L. E. Roberts
and Elizabeth J. wife of C. B. Nipper and my said son Simon said residue?
to be equally divided between my said three children after my son Simon
has received a portion of the equal in value to the share of household
property which said daughters have already received.
6th I hereby
constitute and appoint C. B. Nipper Executor of this my last will &
testament this November 25, 1875.

Sealed declared & published by Levicy Whitaker as her last will &
testament in the presence of us the undersigned who subscribe our names
in the presence of said testator at her special instance and request &
in the presence of each other this Nov 25 1875.

and in open court came T. W. Ballard, John Sneed & W. L. Jones the
subscribing witnesses to the annexed Will of Levicy Whitaker who being
sworn said that they & each of the them saw Levicy Whitaker sign &
publish & declare said paper as her last will & testament. That
they & each of them signed the same as Witnesses at her special
instance & request in her presence & in the presence of each
other on the day the same purports to be signed, that said Levicy Whitaker
at said time was of sound disposing mind &
memory.
