State of Georgia } This indenture made the Seventeenth day of
Habersham County } January in the year of our Lord one thousand
eight hundred and forty four between William Grant Sheriff of the
County of Habersham of the one part and Richard W. Habersham of
the other part. Whereas in obedience to a *writ of Fieri facias
issued out of the Superior Court of the County of Habersham at the
Suit of the Central Bank of Georgia in against Thomas Dooly maker,
John Dooly, James Dooly & William B. Wofford indorsers & Rillburn
Rumsey Security on Stay the said William Grant Sheriff aforesaid
did lately Seize the lot of land herein after described as the
property of the said Thomas Dooly and after being duly and
publicly advertised agreeable to law did on the fifth day of
October 1843 at the place of Public Sales in the County of
Habersham expose the same at Public outcry When the said Richard
W. Habersham being the highest bidder the same was **knocked of to
him at the price or sum of two hundred Dollars – Now this
indenture witnesseth that the Same William Grant Sheriff aforesaid
for and in consideration of the said sum of two hundred dollars to
him in hand well and truly paid by the said Richard W. Habersham
at and before the Sealing and delivering of these presents the
witness whereof is hereby acknowledge hath granted bargained and
Sold __ by these presents doth bargain and Sell unto the said
Richard W. Habersham his heirs and assignees all that tract or lot
of land lying in the thirteenth district of Said County known and
distinguished in the plan of Said district by the Number(91)
Ninety one together with all and Singular the right numbers and
***appurtenances thereof whatsoever to the Said lot of land being
belonging or appertaining and also all the estate, right, title,
interest, property, claim and delivered? [demand?] of the Said
Thomas Dooly in Law equity or otherwise howsoever ____ or to the
Same – To have an d to hold the Said lot of land and premises and
every part thereof unto the Said Richard W. Habersham his heirs
and assigns ____said on fee simple to the only proper use, benefit
and ****behoof of the Said Richard W. Habersham his heirs and
assignes forever and in fee Simple in as full and ample _____ as
the Said Thomas Dooly or his heirs or assignes did or might have
held and enjoyed the same had it not been Seized and Sold under
execution as aforesaid.
In witness whereof the Said William Grant Sheriff hath
hereunto let his hand and Seal the day and year first above
written.
