GEORGIA, HANCOCK COUNTY

This Indenture made and entered into this twentieth day of April in the year of our Lord eighteen hundred and fifty seven, between William Fraley of said county and state duly constituted Executor of the last will and testament of Albert M. Berry late of said county deceased of the one part, and John H. Little of the same place of the other part. Witnesseth, that whereas by virtue of an order granted by the Court of Ordinary of said county. Previous notice of application having been given, agreeably to the statute in such case made and provided on the first Monday in August 1852, to said William Fraley Executor as aforesaid to sell a portion of the real estate of said deceased. After said real estate consisting of a house and lot in the Village of Sparta adjoining lots of Benjamin T. Harris and Richard Sharp containing two acres of land more or less was duly advertised in conformity to law. The said lot was quit ----and exposed to sale to the highest bidder at the court house door in the town of Sparta within the legal hours of sale on the first Tuesday in April instant by said William Fraley executor &c aforesaid; when said lot of land was knocked off to John H. Little he being the highest and best bidder at the sum for the price of sixteen hundred dollars; Now for and in consideration of the said sum of sixteen hundred dollars cash in hand paid to said William Fraley executor as aforesaid by him said John H. Little at and before the sealing and delivery of these presents the receipt is hereby acknowledged said William Fraley Executor as aforesaid hath granted bargained and sold and by these presents does grant bargain and sell unto the said John H. Little his heirs executors administrators and assigns the said lot of land above described containing two acres more or less with all and singular the rights members and appurtenances thereto belonging or in any wise appertaining unto him said John H. Little his heirs executors administrators and assigns to his and their own proper use benefit and behoof forever in fee simple.
