GEORGIA, HANCOCK COUNTY

This Indenture, Made this twenty ninth (29) day of December eighteen hundred and forty six, between Abner A. Cook of the one part, and Albert M. Berry of the other part, both of the County and State aforesaid - Witnesseth - that the said Abner A Cook, for and in consideration of the sum of one thousand five hundred ninety six dollars thirty eight & two third cents to him in hand paid, at and before the sealing and delivery of this deed, the receipt whereof is hereby acknowledged, has granted, bargained, sold and conveyed & does by these presents grant, bargain, sell and convey unto the said Albert M. Berry, his heirs and assigns ( all his right, title, interest, claim and estate, being one undivided one third in and to a certain tract or parcel of land, situate lying and being in the County aforesaid on Beaverdam Creek - the whole tract containing one thousand and eighty acres more or less, being the same tract of land which was conveyed by Hardy C. Culver to the said Albert M. Berry and Abner A. Cook by deed bearing date the 28th day, February 1846, with a plat of said land thereunto annexed, and for a more particular description of the meter and boundaries thereof, reference may be had to said deed and plat.)

To Have and To Hold, said one third of said tract of land to him the said Albert M. Berry his heirs & assigns together with all and singular the rights, members and appurtenance thereof, to the said third part of said tract of land in any manner belonging, to his own proper use, benefit & behoof forever in fee simple. And the said Abner A. Cook for himself his heirs executors and administrators, the said bargained premises unto the said Albert M. Berry his heirs & assigns will warrant and forever defend the right and title thereof themselves, and against the claim of all other persons whatsoever.

In witness whereof the said Abner A. Cook has hereunto set his hand and affixed his seal the date first herein written. The words “Albert M.” and “himself” intentions.
