Full Title: AN ACT to legalize and make valid certain deed records, as recorded in book marked A, in the clerk's office of the superior court of Henry county, and to authorise the justices of the inferior court of said county to pay for transcribing the same.
Whereas at the organization of said county, a number of deeds of conveyance were recorded in books not bound, and the same having since been transcribed as aforesaid,
Be it therefore enacted by the Senate and House of Representatives of the State of Georgia, in general assembly met, and it is hereby enacted by the authority of the same, That from and immediately after the passage of this act, it shall be the duty of the justices of the inferior court of said county, or a majority of them, to examine the said transcript, and compare the same with the original record, and if the same be correctly transcribed, they shall certify the same and deposit the said record book in the clerk's office of the superior court of said county, and the same shall become a part of the records of said county, and shall be held as good and valid in law as though the same had never been transcribed.
Sec. 2. And be it further enacted, That the justices aforesaid shall allow whatever in their discretion shall seem to be a reasonable compensation for transcribing the aforesaid record out of the county funds of said county -- Provided, the said court is left discretional whether they will pay for said transcript or not.
Sec. 3. And be it further enacted, That all laws, and parts of laws, militating against this act, be, and the same are hereby repealed.

James Harkness to Alfred Bankston

This indenture made this the Eleventh day of October in the year of our Lord one thousand and thirty three, between James Harkness of the one part and Alfred Bankston of the other part, witnesseth that the said James Harkness, for and in consideration of the sum of Two hundred and twenty five dollars in hand paid the receipt, whereof is hereby acknowledged, hath granted bargained and sold and doth by these presents grant, bargain and sell unto the said Alfred Bankston, his heirs and assigns, the undivided half of Lot No. 77,(seventy seven) in the first district of originally Henry, now Butts County, containing one hundred and one acres, more or less, there being a school house on said tract of land one fourth of an acre reserved for said school house so long as said house stands and then to go to Bankston and his heirs, said tract of land being the east half. To have and to hold, with all and singular the rights members and appurtenances, to the said Alfred and his heirs and assigns, and the said James, doth by these presents warrant and forever defend from himself and his heirs and assigns and from all other persons to the said Alfred, and his heirs and assigns forever due fee simple. This indenture made this fifteenth day of September in the year of our Lord Eighteen Hundred and Twenty Four and in the forty ninth year of the independence of the United States of America between Roland Williams of the County of Henry of the one part and John Bankston of the County aforesaid of the other part. Witnesseth that the said Roland Williams for and in consideration of the sum of one hundred dollars to him in hand paid at or before the delivery of these presents the receipt whereof is hereby acknowledged hath granted, bargained, sold, aliened conveys and confirms and by these presents do grant, bargain, sell, alien, convey and confirm to the said John Bankston, his heirs and assigns. Fifty acres of land lying in a square in the ninth district corner of that Lot of Land known by No. Fifty, situate with Ninth District, of Henry County lying and being on the waters of yellow water creek to have and to hold the said parcel of land together with all and singular the rights, members and appurtenances with the remainder and remainders, revision and revisions rights, issues and profits thereof to the only proper use benefit and behoof of him the said John Bankston, his kin and assigns.
In fee simple and the said Roland Williams, his heirs and assigns the said bargained land and premise unto the said John Bankston his heirs and assigns against the said Roland Williams hath hereunto set his hand and affixed his seal the day and year first above written.

Jane B. Tyson to Alfred Bankston

This indenture made and entered into this the tenth day of November in the year of our Lord Eighteen Hundred and thirty eight. Between Jane B. Tyson of one part and Alfred Bankston of the other part both of the County and State aforesaid. Witnesseth that the said Jane B. Tyson for and in consideration of the sum of four hundred dollars to her in hand paid at and before the sealing and delivery of these presents the receipt wherereof is hereby acknowledged hath granted bargained and sold and doth by these presents grant bargain sell and convey unto the said Alfred Bankston his heirs and assigns all that tract or parcel of land situate lying and being in the second district of originally Henry now Butts County. The county line running through the same know(? )and distinguishes in the plain(?) of said district by lot number one hundred and twenty nine containing two hundred two and a half acres more or less to have and to hold thee aforesaid parcel of land with all and singular the rights members and appurtenance thereto beginning for his and their own assign use benefit and behoof forever in fee simple. And the said Jane B. Tyson for herself her heirs and assigns the said bargained tract or parcel of land shall and will warrant and forever defend the right and title thereof to the said Alfred Bankston from the claims of herself and from the claims of all and every other person or persons whatever. This indenture made this the 27th twenty seventy day of Oct. in the year of our Lord One Thousand Eight Hundred and sixty nine between Alfred L. Bankston of the one part and William E. Pullin of Henry County of the other part. Witnesseth that the said Alfred L. Bankston for and in consideration of Twelve Hundred Dollars in hand paid at and before the sealing and delivery of these presents the receipt whereof is hereby acknowledge hath granted bargained sold and conveyed unto said William E. Pullin his heirs and assigns all that parcel or tract of land. One half of lot of land in the first district of originally Henry now butts County known by the number of half lot of One Hundred and Seventy Five containing One Hundred One and fourth acres. With all the rights appurtenances thereon belonging to have and to hold the said described parcel of land with the said William E. Pullin his heirs and assigns administration or executors to his or their own proper use benefit and behoof forever in fee simple against the claims or claims of any and all persons or persons whereof Alfred L. Bankston have this day set my hand and affixed my seal this 27th day of October eighteen Hundred and sixty nine.

Boling K. Bankston to William S. Blissit

This indenture made this the thirteenth day of November eighteen hundred and forty five between Boling K. Bankston of the one part and William S. Blissit of the other part both of the County and State aforesaid. Witnesseth that the said Boling K. Bankston for and in consideration of the sum of one hundred and seventy dollars to him in hand paid at and before the sealing and delivery of these presents the receipt whereof is hereby acknowledged hath granted bargained and sold and by these presents doth grant bargain and sale unto the said William Blissit his heirs and assigns all the following described land, it being a part of lot No. Eighty one in the first district of originally Henry, now Butts County containing thirty five acres more or less and situated as follows. Commencing on the line between lands now owned by Phinekus Kimbell and the estate of James E. Bankston, deceased and running east fifty four rods, then a south to this line between land now owned by David D. Bailey, thence west along said line to the corner between the land owned by Phinekus Kimbell and the estate of James E. Bankston, Desc. Thence north along said line to the place first mentioned. To have and to hold said bargained promises together with all and singular the rights members and appurtenances thereof to the only proper use benefits and behoof him the said William S. Blissit his heirs and assigns forever in fee simple. And the said Boling K. Bankston his heirs and assigns, will warrant and forever defend the premises hereby conveyed unto the said William Blissit his heirs and assigns against the claim of all and every person or persons whatever. In witness whereof the said Boling K. Bankston hath hereunto set his hand and applied his seal the day and year first above written.

This indenture made this 3rd day of August in the year of our Lord Eighteen Hundred and Twenty One between Reuben Bankston of the one part and state aforesaid, and John Lewis of the same state and county aforesaid of the other part. Witnesseth that for and in consideration of the sum of Eighty dollars to me in hand paid by the said John Lewis at or before the signing and delivering there presents the receipt whereof is hereby acknowledged hath granted, bargained and sold and by these presents doth bequest, bargain and sell, release and convey unto the said John Lewis his heirs and applying a certain parcel of land containing fifty acres being the same more or less it being the south east corners of Lot No. 144 in the third district of Butts County, originally Monroe, now Butts County, to have and to hold the said lands together with all and singular the rights members and appertaining unto the said John Lewis, his heirs and assigns forever to his and their own people and benefits and behoof forever in fee simple and the said Reuben Bankston for himself his heirs expeditors and administrator shall and will warrant and will forever defend the rights and title of said on parcel of land unto the said John Lewis his heirs and assigns against the claims of himself and against the claims of all other person or persons whatsoever in witnesseth whereof the said Reuben Bankston hath hereunto set his hand and assigns his seal the day and date above written.

Samuel Collins to Lavisa Collins

Lot #67, 2nd District
Written: September 28, 1866

This indenture made this 28th September 1866 between Samuel Collins of Butts County and State aforesaid of the one part and his wife Lavisa of the same place of the other part. Witnesseth that the said Samuel Collins for and in consideration of the natural love and affection which he has and bears to his said wife Lavisa hath given, granted, conveyed and does by these present give grand and convey unto his said wife Lavisa after his death for her own use benefit &c, but until his death to remain his and be cultivated and managed as heretofore by him or as he otherwise pleases. Except the sale of it and if she should die first this deed to be void. The south half of lot of land number sixty seven in the second district originally Henry, now Butts County, containing one hundred, one and one fourth acres, more or less being the place upon which said Collins now resides and supposed by him to be worth five hundred dollars. To have and to hold said land unto his (as pr the condition alone) the said Lavisa Collins her heirs and assigns together will alike and singular the rights. Members and appurtenances to the same in any manner belonging to her and their own proper use benefit and behoof (after said Collins death) for ever in fee simple

This indenture made the second day of October in the year of our Lord one thousand and twenty three between Archibald Bachellor of the county of Jones and state aforesaid of the one part and John A. Ellis of the county of Oglethorpe and state aforesaid of the other part Witnesseth that the said Archibald Bachellor for and in consideration of the sum of Five hundred Dollars to him in hand paid before the sealing and delivery of these presence the receipt whereof is hereby acknowledged hath granted bargained sold and conveyed and by these presence doth grant bargained sold and conveyed unto the said John A. Ellis his heirs and assigns all that tract or parcel of land situate lying and being in the county of Henry known and distinguished by lot no. two hundred and six in the second district of said county to have and to hold together with all and singular the rites member and appurtenances there unto belonging to his and their own proper use benefit and behoof forever in fee simple and the said Archibald Batchellor his executors and administrators will warrant and forever defend the right and title against the claim of themselves and against the claims of any other person or persons whatsoever. This indenture made the 24th day of January in the year of our Lord one thousand eight hundred and twenty eight between Hillary Brooks of the county of Henry and state aforesaid of the one part and Willis Ellis of the county of Henry and state aforesaid of the other part Witnesseth that the said Hillary Brooks for and in consideration of the sum of two hundred thirty seven dollars & fifty cents to him hand paid at or the sealing and delivery of these presents the receipt whereof is herby acknowledged hath granted bargained sold and conveyed unto the said Willis Ellis all that tract or parcel of land lying and being in the county of Henry known and distinguished by lot No. 162 in the third district one half of said lot all on the west side of a branch beginning at a red oak Andersons corner thence west to a pine thence north across said lot No. 162 then east to the said branch then up the meanders of said branch to the beginning corner to have and to hold together with all and singular the rites members and appurtenances thereunto belonging or in any manner whatsoever to his own proper use benefit and behoof forever in fee simple and the said Hillery Brooks for himself will warrant and forever defend the right and title of said land above mentioned from the claims of himself and all other persons whatsoever. Written: March 6, 1837
Georgia, Elbert County This indenture made and entered into this the sixth day of March One thousand eight hundred and thirty seven Between William Dooly of the aforesaid County and J.A. Ellis of Henry County both of the aforesaid state. Witnesseth that for and in consideration of the sum of two hundred and fifty five dollars the receipt of which is hereby acknowledged I William Dooly hath bargained sold released and conveyed and by these presents do bargain sell release and convey unto the said J. A. Ellis all that tract or parcel of land situated lying and being in the County of Henry and State aforesaid containing two hundred two and one half acres known and distinguished as lot number one hundred and ninety five (195) having such shapes and marks as will fully appear by a reference to the plat on the grant herewith transferred for him the said J.A. Ellis his heirs & assigns to have and to hold the aforesaid bargained premises and all and singular the rights titles hereditaments and appurtenances thereunto belonging or in any wise appertaining forever in fee simple. And I the said William Dooly will bind myself my heirs and assigns forever warrant and defend the right and title to said land free from the lawful challenge or claim of myself or any other person or persons whomsoever so that the said J.A. Ellis his heirs and assigns shall forever be peaceably possessed of the same.

William Everitt to William Ellis

This indenture made the sixth day of September in the ear of our Lord One Thousand eight hundred and thirty one between William Everitt of the county of Randolph of the one part and William Ellis of the County of Henry of the other part. Witnesseth that the said William Everitt for and in consideration of the sum of Four hundred dollars to him in hand paid at and before the sealing and delivery of these presents the receipt whereof is hereby acknowledged hath granted bargained sold and conveyed and do these presence grant bargain sell and convey unto the said William Ellis his heirs and assigns all that tract or parcel of land situate lying and being in the county of Henry and known and distinguished by the No. ninety six (96) in the third district of the aforesaid county of Henry containing Two Hundred two and one half acres be the same more or less. To have and to hold said Tract or parcel of land unto him the said William Ellis his heirs ans assigns together with all and singular the Rites members and appurtenances thereof to the same in any manner belonging to him and their own proper use benefit and behoof for ever in fee simple. And the said William Everitt for himself for his heirs executors and administrators the said bargained premises unto the said William Ellis his heirs and assigns will warrant and forever defend the right and title thereof against themselves and against the claims of all other persons whatsoever. This indenture made this twenty fourth day of August eighteen hundred and thirty eight between U. M. Gelder of said county of one part and William Ellis of the county of Henry of the other part both of state aforesaid Witnesseth that the said Uriah M. Gelder for and in consideration of the sum of one thousand dollars to him in hand paid the receipt whereof is hereby acknowledged hath granted bargained sold and conveyed unto the said William Ellis his heirs and assigns all that tract parcel or lot of land situate lying and being in the third district of Henry County known and distinguished in plan of said district by lot No. (64) sixty four. To have and to hold said bargained premises together with all and singular the rites members and appurtenances thereunto belonging and the said Uriah M Gelder for himself his heirs and assigns doth agree to forever warrant and defend said bargained premises free from the claim or claims of each and every person or Persons whatsoever unto the said William Ellis his heirs &c in fee simple.

This indenture made and entered into this twentieth day of March in the year of our Lord eighteen hundred & thirty five between John Harp of the county & state aforesaid and R. P. Ellis of the same place of the other part Witnesseth that the said Harp hath this day bargained & sold unto the said R. P. Ellis a certain parcel of land containing fifty acres it being part of lot No. sixty two (62) being in Henry county and 3rd district & state aforesaid beginning at the north west corner of said lot in third district of Henry county thence east eleven chains & twenty links to a stake thence south forty five chains to a stake thence west eleven chains & twelve links to a stake thence north forty five chains to the beginning containing fifty acres more or less for & in consideration of the sum of one hundred dollars to him in hand paid before the sealing and delivering of the presents and the said Harp do by these bind himself his heirs & assigns to warrant and defend the rights & title of said parcel of land & all appurtenances thereunto belonging unto the said R. P. Ellis his heirs & assigns free from the claim or claims of all other person or persons whatsoever to have & to hold to there own proper use benefit & behoof forever in fee simple In wittiness whereof I have here unto set my hand & seal the day and date above written. Ellis of the County of Oglethorpe &c State aforesaid. Witnesseth that the said George Lewis hath this day made &c delivered to the said John A. Ellis the certain promissory note subscribed with his hand and bearing even date with these presents thereby the said George Lewis hath promised to pay the said John A. Ellis or bearrer one hundred & twenty three dollars & twenty five cents on or before the twenty fifth day of December next ensuring the date hereof for value received now for & in consideration of the sum of one hundred and twenty five dollars by the said John A. This indenture made this third day of August in the year of our lord One Thousand Eight Hundred and Thirty; between Benj. Star of the County of Wilks and State aforesaid of the one part and John G. Ogletree , Samuel Ogletree , Hope Ogletree, Thomas Ogletree, Pierce Ogletree, Absalom Ogletree ,James, and the heirs of Francis H. Ogletree diseased all of the other part ; Witnesseth that the said Benj. Starr for and in consideration of the sum of two hundred and fifty-six dollars to him in hand paid by the above named family of children at or before the signing of these presents, the receipt hearof is hereby acknowledged hath granted bargained and sold unto the above named family of Ogletree’s their heirs and assigns. Eighty seven acres of land situate in the fourth district of Henry now Fayette County it being apart of lot No. one hundred and forty-seven in the fourth district of Henry now Fayette County. To have and to hold the said Eighty-seven acres of said lot of land with all and singular the members and appurtenances thereof whatsoever unto the above named family of Ogletree’s their heirs and assigns to their own proper use benefit and behoof forever in fee simple: and the said Benj, Starr for himself his heirs and assigns the said bargained land and premises will forever warrant and defend the right and title thereof from himself his heirs Executors and administrators and from every other person or persons whatsoever unto the said John G. Ogletree, Samuel, Hope, Thomas ,Pierce, Absolom, James and the heirs of Francis H. Ogletree their executors &c.

To All To Whom These Presents Shall Come, Greeting:
Know Ye, That in pursuance of an act of the General Assembly, passed the 15th of May, 1821, for making distribution of the land lately acquired of the Creek Nation of Indians, and forming the counties of Dooly, Houston, Fayette, and Henry, in this State, I HAVE GIVEN AND GRANTED, and by these presents, in the name and behalf of this State, DO GIVE AND GRANT, unto Green Bell of Burks District Burke County, his heirs and assigns forever, all that Tract or Lot of Land, containing two hundred two and a half acres, situate, lying, and being in the Twelfth district of Henry county, in the said State, which said Tract or Lot of Land is known as distinguished in the plat of said district by the Number Twenty having such shape, form, and marks, as appear by a plat of the same hereunto annexed: To have and to hold the said Tract or Lot of Land, together with all and singular the rights, members, and appurtenances therof, whatsoever, unto the said Green Bell his heirs and assigns; to his and their proper use, benefit and behoof forever in fee simple.
Given under my hand and the Great Seal of the State, this twenty third day of December in the year of our Lord eighteen hundred and Twenty five and of the fiftieth year of American Independence.
