Will of Miles M. Roberts
State of Georgia
Lumpkin County
In the name of God, Amen.
I, M M Roberts of Said County and State Being of Sound mind and memory and knowing that in the course of humane event I must Soon depart this Life think It proper to dispose of the Small Estate of which I may be Possessed at the time of my death.
Item 1st: I desire that after my death my Body shall be Buried in a decent christian Like manner in hope of the reserection to immortal life through the Merits of the Lord and Savior Jesus Christ.
Item 2: First of all I desire that all my Just debts shall be paid By my Executors If any Remain After my death as Soon as can well be done, to be raised out out of my Live Stock If any on hand.
Item 3: I will and Bequeath to my Beloved Wife Louiza Ann the Lots of Land Numbers 1147 & 1148 in the 11th Dist & first Section of Said County containing 40 Acres each More or Less with all and Singular the Teniments and appertainences thereunto Belonging for and during her natural Life and at her death to go to and become the absolute Property of my Son Marion C Roberts to be valued to him by any Three disinterested good men of the Said County If he desires to buy Said Lands and teniments by paying the ammount of Such valuation to the Five children of my Son Dohurty and the children of my Daughter Mary Share and Share alike between all Said children but all the House hold and Kitchen furniture I bequeath to my Said Wife Absolutly to dispose of as she desires.
Item 4th: I bequeath to my Son Marion C Roberts Lots of Land Nos 1156 = 1157 and 5 acres off the North Side of No 1220 in the Said Dist and County as above Stated upon any Balance that may be due to my Friend John Simmons on a mortgage Judgment obtained in Lumpkin Superior Court on a part of Said Land.
Item 5: I herby appoint my Said Wife and my Son Marion C Roberts my Executors to Exicute this my will with full Power and authority to Sell the two first mentioned Lots of Land at Public or Private Sale as Said Exicutors deem best in the event my Said Son Marion C Roberts does not desire to pay for them at the valuation as above Provided for but in the event of Such Sale by my Said executors the Proceeds of Said Sale are to be divided Equaly among my Said Grand children as above Stated.
In testimony whereof I have hereunto Set my hand and Seal this 2nd day of May 1884.
Miles M. Roberts (Seal) The forgoing will of M M Roberts was Signed Sealed, declaired and Published by him in our presents as his Last will and testament and we have Signed the Same as Witnesses In his presents and In presents of each other at his Request.
