This Indenture made the 28 day of October 1792 between Joils Kelly of the one part and Joseph Gartrell of the other part both of the county of Wilkes and state aforesaid Witnesseth that the said Joils Kelly and Nancy his wife for and in consideration of seventy pounds sterling to them in hand paid by the said Joseph Gartrell the receipt whereof is hereby acknowledged have bargained and sold and by these presents do confirm all that tract of land lying on the east side of Kemps Creek left to him by will of his father after the death of his mother pattained to said John Kelly deceased lying in the county of Wilkes and state aforesaid unto the said Joseph Gartell his heirs and assigns forever. Beginning at a sassafras station on the sd. creek Flanagans old line S61& P. oak N 29 W26chs. W.Oak x N 65 E 7 x P.O. N23 E 10 Rdo S36 E 42 to a po x east 16 to a p.o. x South 44 chs. W oak x down br to the said Kemps Creek thence up sd. creek to Goldwires Line on sd. line N. 10 W 22 to a p.o. x S 80 W to Mulberry Station on the creek thence up sd. creek to the beginning containing two hundred acres less or more. Together with all and singular the sd 200 acres of land and premises, belonging, or in anywise appertaining; after the death of sd. Joils Kellies mother.. also all the estate, right , title, or interest, which they the sd. Joils Kelly and Nancy his wife: now have by virtue of will.. of in and to the sd. 200 acres of land To have and to hold the said two hundred acres of land and premises unto the said Joseph Gatril his heirs and assigns and the said Joils Kelly and Nancy his wife for themselves and heirs will warrant and defend the said tract of land and premises unto the said Joseph Gatril his heirs and assigns from all persons whomsoever except the reserved life time of his mother Ann Kelly In witness the sd. Joils Kelly and Nancy his wife have hereunto set their hand and seals the day and year first above written
