WILL OF MRS. MARY L. ELLIS

 

GEORGIA, SPALDING COUNTY

I, Mary L. Ellis, being of sound and disposing mind and memory, do make and declare this my last will and testament.

                                                Par. 1st.

I will that all my just debts be paid as soon as practicable after my death.

                                                Par. 2nd .

I will and devise that my home place and personal property be kept together until my youngest child, Louise, arrive at her majority.

                                                Par. 3rd.

After Louise arrives at her majority I will that my home place where I now reside and my personal property (except such as is hereinafter mentioned) be equally divided in kind among my nine children, to wit:  Jesse T. Ellis,, James T. Ellis, Julia Elizabeth Story, George P. Ellis, Frank C. Ellis, Hubert R. Ellis, Riley E. Ellis, Otis B. Ellis, Louise Ellis.

                                                Par. 4th.

I will that my house and lot in Lyndon Park be sold and the proceeds be equally divided among my children, except Jesse T. from whose share shall be deducted $57.00 which shall be paid to Julia Elizabeth Story.

                                                Par. 5th

I will to Louise my suit of oak furniture and my sewing machine.  All the rest of my property to be equally divided among all my children except as above mentioned.

                                                Par. 6th.

I regret to say that my husband, James R. Ellis, has been so very unkind and unjust to me that I do not want him to receive one cent from my estate.

                                                Par. 7th.

I nominate two of my sons, to wit:  James T. Ellis and Frank C. Ellis to act as Executors of this my will without bond, inventory or appraisement, but I request that they make a final return to the Ordinary.

In testimony whereof I hereto set my hand and seal this 12th day of May, 1913.

Signed, sealed, published and declared by Mrs. Mary L. Ellis to be her last will and testament she signing in our presence and we signing in her presence, at her request, and in the presence of each other, this 12 day of May, 1913.

I, H. T. Johnson, do swear that I, as well as J. A. Drewry and L. Thompson saw the within Mary L. Ellis, sign and publish the within attached paper as her last will and Testament, that I subscribed the same as witness thereto, at the special instance and request of the said Mary L. Ellis and in her presence, as did J. A. Drewry and L. Thompson in the presence of testatrix and of each other; that the said Mary L. Ellis signed the same freely and voluntarily, and _______.
